It is a law in all states that in order to drive a vehicle you must be covered by automobile insurance. All states have minimum coverage that insurance companies must meet when they issue an insurance policy for a driver. Florida law requires a minimum $10,000 policy of personal injury protection, also known as PIP.
PIP insurance is specifically to cover auto accident medical costs and lost wages. After an accident all people injured in a car accident should seek medical treatment to determine the extent of their injuries. Often times injuries remain hidden and people mistakenly think that the soreness in their back or neck will simply go away. By failing to seek medical treatment you may be asking for a much lower settlement that will not cover your actual injuries. This is what PIP insurance is meant to be used for.
Insurance companies provide everyone with PIP insurance not because they are concerned about the well being of their clients but because it is the law. They would rather you never spent a dime of your PIP coverage on medical examinations. They trust that a majority of their clients will ignore the soreness in the back and/or neck and accept the quick settlement that the company will offer. Many Insurance companies actually advertise how fast they settle cases.
The problem with the quick settlement is that you must sign for it. The document that you sign relieves your insurance company from any additional liability for that accident. You take the money offered, your insurance company wipes their hands of you, and any other injuries that develop are yours and yours alone to deal with. Now wait a minute - what was the purpose of paying all those years for car insurance if you are going to be left out to dry?
Many people are concerned that if they don't accept a quick settlement or if they hire an attorney their insurance premiums will go up. No one need worry themselves about that - if you are in an accident, even if it is not your fault, your insurance company may raise your rates regardless of what you do.
Some companies now claim to have accident forgiveness. The conditions that must be met are not disclosed on the ads but most include long durations without an accident or higher initial premiums.
If involved in a car accident with multiple vehicles you will be requested to give a recorded statement to your insurance company. Under your policy you will have to do this at some point. We would like to talk to you before you give this statement.
The insurance company for the other driver(s) will also request a recorded statement. Do not give this statement before talking to us. These statements can be twisted to hurt your case. As an example, you are involved in a car accident and several days later your back is still sore. You are asked to give a statement and you describe your back pain as "mild." You later develop severe back pain and are diagnosed with a herniated disk. Now when you try and settle for compensation covering the herniated disk the insurance company claims that the injury is exaggerated or due to something other than the claimed accident based on your previous statement.
The fact remains that your sore back or kink in your neck could be much more serious than you think. You have already paid for insurance that will cover the medical expense to have yourself checked out. The benefit is there for you to use. The only thing you will be guilty of is making sure you are okay - and hopefully you are. So, the question remains, why not use it?
