Orlando At Fault Car Accident Victims

Have you been in an accident that was caused by another but you were cited for violating the law?  Or maybe you feel it was your fault.  In a car accident case, usually one of the drivers will receive a citation saying that they violated the law by driving carelessly, for example. Negligence and Traffic Tickets: Why it doesn't matter that you received the ticket.

Traffic tickets must be proven by the "beyond reasonable doubt" standard.  It is simply a way of say one car was the most at fault therefore that driver gets the ticket.  It does not alleviate the other driver from all responsibility.  If a ticket carried that much weight, what happens when the traffic ticket gets dismissed because no one came to the traffic court hearing?  Does that mean no one is at fault?

Negligence, in a civil lawsuit, can be separated into percentage of fault.  This means that even though you may have received the ticket it does not mean the other driver does not bear any responsibility.  Keep that in mind.

Car Accident? Do Not Worry

Traffic Tickets can be challenged and in accident cases they should be challenged (click Traffic Ticket Defense for more information).  Furthermore, because you received the ticket does not mean you cannot receive compensation for your injuries, car damage, etc.

Accident cases are civil - not criminal.  This means comparative fault is at issue.  You may have received the citation but the other driver may still have been 40% at fault for the accident.  That means he is 40% responsible.  And if a jury comes back and says he was 75% at fault then that driver is 75% responsible.

What Not to Do...

Never admit fault to a car accident.  The fact is you really don't know and by admitting fault you alleviate law enforcement from doing a thorough investigation.  Let law enforcement do their job.

Things to be thinking about if you are involved in an accident

Where did the accident occur?  Were the police called?  Was a report filed?  Did you exchange insurance information? Have you contacted your insurance company?

Those are some initial questions we will need to know.  In addition, we will need to see the following if you have them - if not, we can still help.

  • Name of insurance carrier and policy number.
  • Name of family doctor if you have one.
  • Name and policy number of health insurance.
  • List of all injuries sustained in crash.
  • Accident report.
  • All traffic tickets given to you.
  • Name of other driver's insurance company.
