This is our main page for car accident injury victims. To the right under "Additional INFO" are some additional links with more information that may be of some help.
As an attorney that deals with driving accident victims daily, there are several questions you need to ask yourself if you have been involved in a highway accident:
Where you injured? The problem that we all face right after a car accident is that we really don't know the extent of our injuries. That is why Florida law requires that all insurers provide "Personal Injury Protection" as a minimum with all car insurance policies. Personal Injury Protection, or PIP, provides coverage for medical expenses due to a car accident up to 80% of the first $10,000 (you can have higher coverage if you ask for it with your insurance carrier).
Have you spoken to your doctor? Most car accidents do not involve blood and broken bones however almost all car accidents do involve a traumatic shock to the body. This has been called "whiplash" or "backlash" and it can cause serious long-term injury to a person's neck, back, and or hips. Without treating with a doctor these injuries can go unnoticed for months and if you settle your case without first seeking a doctors opinion you will end up with more medical expenses that will not be covered by your insurance policy.
Has sufficient time passed for your "soreness" to go away? Being sore after a car accident may seem like a minor issue. The thought is that it will go away - or so you think (hope). Before you settle with your insurance, make sure you know what is wrong with you. This is why your auto insurance will cover your medical bills due to an accident - so that you can settle with your insurance provider intelligently.
Hearing from my clients it seems that similar issues always arise with a driving accident. Your car gets damaged or totaled. You get bounced around and need to receive medical attention, even if it is only to make sure you are okay. You need to file a claim for insurance. And, yes, you have to pay for all these things with time and money.

We will help you find a doctor if you do not have a family doctor, we will get the insurance companies to pay for your care, and we will help you with your property damage. We try to give you complete help so you don't have to struggle with these questions or, more importantly, how to pay for them.

Insurance companies have contracted with you to "insure" you in case of an accident. They will want you to provide them with some reason not to cover any of your claims. Yes, they are in it to make money - not pay out money. There is nothing wrong with this unless they are trying to avoid their contractual obligations with you.
The less they give you the more they make - it is that simple. A quick settlement means they will be relieved from covering your injuries as they develop. That is why it is important to treat with a doctor to determine the total extent of your injuries before negotiating with your insurance company.
If you have been in a car accident and you think you are lucky because you came away with only a sore back - you may not be lucky. Many times car accidents result in back or neck injuries whose extent does not become apparent until months later. Having a doctor treat you is the best way to determine the extent of your injuries - and it is the extent of your injuries that you have insured. Shouldn't you find out what the extent of the injuries are before settling with your insurance provider (or the at-fault driver's insurance)?
Personal Injury Protection is required for all motorists under Florida law. This insurance coverage is to pay for medical expenses resulting from a motor vehicle accident. Eighty percent of the first $10,000 is the minimum amount of coverage required. So you do not need to use your health insurance to pay for these procedures. This is part of your insurance policy that you pay for and you should use it when it is needed.
You don't have to wait for us. If you have injuries see your doctor. If you don't have a doctor call us - we will find one close by your house so that your treatment is as convenient as possible. Don't sit around believing the pain will go away - use your PIP and see a doctor immediately.
Where did the accident occur? Were the police called? Was a report filed? Did you exchange insurance information? Have you contacted your insurance company?
Those are some initial questions we will need to know. In addition, we will need to see the following if you have them - if not, we can still help.
