Injuries Caused by Falls

People are injured everyday by falls, sometimes called "slip and falls."  Many times the fall is due to the fault, or negligence, of the person that fell.  However, sometimes the fall is due to the negligence of others or a combination of negligence between the parties.

Were there any Damages?

Another question is whether there are any damages.  You may fall due to another person's negligence but if you are not hurt physically or emotionally or professionally - there may be nothing to collect on.  Any lawsuit filed under a slip and fall theory will require that there be something that has "changed" for the worse.  These are called damages. 

Damages can be a broken bone, a soft tissue injury such as a severe bruise, spinal or ligament damage, or embarrassment that effects quality of life - typically to the aspect of ability to earn income.

Is there Monetary Coverage?

Someone could be at fault causing you to fall and seriously injure yourself but be considered judgment proof - meaning there is no money that the person has to cover your relief.  You could file a lawsuit against a person considered judgment proof but it would cost you money to do this and you will end up with a piece of paper called a "judgment" - worthless in most such cases.  Most of the time the money for such incidents is usually derived from insurance coverage.  Stores have to have general liability coverage.  Homeowners have to have home-owners insurance.

There are other sources of funds besides insurance.  A person's personal wealth could be accessed, property can be attached, wages can be garnished.
